1) scope of application
1.1 These General Terms and Conditions (hereinafter “GTC”) of ETAPLEX GmbH (hereinafter “Seller”) apply to all contracts for the delivery of goods that a consumer or entrepreneur (hereinafter “Customer”) concludes with the Seller with regard to the goods presented by the Seller in its online shop. The inclusion of the customer's own terms and conditions is hereby objected to, unless otherwise agreed.
1.2 These General Terms and Conditions apply accordingly to contracts for the delivery of vouchers, unless expressly stipulated otherwise.
1.3 A consumer within the meaning of these General Terms and Conditions is any natural person who concludes a legal transaction for purposes that cannot primarily be attributed to their commercial or independent professional activity. An entrepreneur within the meaning of these General Terms and Conditions is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.

2) Conclusion of contract
2.1 The product descriptions contained in the seller's online shop do not represent binding offers on the part of the seller, but rather serve to make a binding offer by the customer.
2.2 The customer can submit the offer using the online order form integrated into the seller's online shop. After placing the selected goods in the virtual shopping cart and going through the electronic ordering process, the customer submits a legally binding contractual offer with regard to the goods contained in the shopping cart by clicking on the button that completes the ordering process. The customer can also submit the offer to the seller by telephone, fax or email.
2.3 The seller can accept the customer's offer within five days by sending the customer a written order confirmation or an order confirmation in text form, by delivering the ordered goods to the customer, or by asking the customer to pay.
2.4 If you select the payment method “PayPal Express”, payment will be processed via PayPal under its terms and conditions.
2.5 If you select the payment method “Amazon Payments”, payment is processed via Amazon Payments Europe s.c.a. on their terms.
2.6 The contract text will be saved and sent to the customer after the order is placed. If you use a customer account, the contract can be accessed there.
2.7 Before bindingly submitting the order, the customer can identify and correct input errors.
2.8 The contract language is exclusively German.

3) Right of withdrawal
3.1 Consumers generally have a right of withdrawal.
3.2 Further information on the right of withdrawal can be found in the seller's cancellation policy.
3.3 The right of withdrawal does not apply to consumers outside the EU with residence and delivery address outside the EU.
4) Prices and payment terms
4.1 The prices stated are total prices including statutory sales tax. Shipping costs are stated separately.
4.2 Deliveries abroad may incur additional costs such as customs duties or fees.
4.3 The available payment options are stated in the online shop.
4.4 If payment is made in advance, payment is due immediately after conclusion of the contract.
4.5 When paying via PayPal, the PayPal terms of use apply.
5) Delivery and shipping conditions
5.1 Delivery is made to the delivery address specified by the customer. When paying with PayPal, the address stored with PayPal applies.
5.2 Return costs in the event of non-delivery are borne by the customer if he is responsible for the non-acceptance.
5.3 Self-collection is not possible.
5.4 Vouchers are sent by email.
6) Retention of title
If the seller makes advance payment, he reserves ownership of the goods until full payment has been made.
7) Liability for defects (warranty)
7.1 The statutory warranty regulations apply.
7.2 The customer is asked to report any obvious transport damage upon delivery.
8) Redeeming promotional vouchers
8.1 Promotional vouchers are only valid for the specified period and cannot be purchased.
8.2 Restrictions may arise from the voucher content.
8.3 Vouchers must be redeemed before completing the order.
8.4 Only one promotional voucher can be redeemed per order.
8.5 Remaining amounts will not be refunded.
8.6 Difference amounts must be settled using other payment methods.
8.7 No right to cash payment.
8.8 No refund if the goods are returned.
8.9 Vouchers are personal and non-transferable.
8.10 The seller can change conditions or deactivate vouchers at any time.
9) Gift voucher redemption
9.1 Gift vouchers can only be redeemed in the online shop.
9.2 Valid until the end of the third year after purchase.
9.3 Redemption only possible before order completion.
9.4 Multiple gift vouchers possible per order.
9.5 No redemption for the purchase of additional vouchers.
9.6 Differences must be settled using other payment methods.
9.7 No cash payout, no interest.
9.8 Vouchers are personal and non-transferable.
10) Applicable Law
10.1 German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Consumer protection remains unaffected.
10.2 This choice of law does not apply to consumers outside the EU.
11) Place of jurisdiction
11.1 The place of jurisdiction is the seller's registered office if the customer is a merchant or legal entity under public law.
11.2 The seller can also appeal to the court at the customer's registered office.
12) Alternative Dispute Resolution

12.2 The seller is not obliged or willing to take part in a dispute resolution procedure before a consumer arbitration board.
